1. Agreement to Terms

By accessing or using Community Swarm ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Community Swarm provides AI-powered community management tools for Discord and Telegram platforms, including but not limited to:

• Real-time message monitoring and sentiment analysis
• AI-powered engagement through configured personas
• Analytics and reporting on community health
• Daily AI-generated summaries and alerts

3. Account Registration

To use our Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized account access
• Accept responsibility for all activities under your account

4. Platform Terms Acknowledgment

We provide safety measures including organic behavior simulation, rate limiting, and ban detection with notifications, but cannot guarantee immunity from platform enforcement actions.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm other individuals or communities
• Spread spam, misinformation, or malicious content
• Impersonate others in a deceptive manner
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Engage in market manipulation or fraudulent schemes
• Collect user data for purposes not disclosed to community members

6. Subscription and Payment

6.1 Pricing

• Discord Only: $1/month
• Telegram Only: $1/month
• Full Access (Both Platforms): $2/month
• Enterprise: Custom pricing

6.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. Annual subscriptions receive a 20% discount. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

6.3 Free Trial

We offer a 14-day free trial for new users. No credit card is required to start. You will not be charged unless you explicitly subscribe after the trial period.

7. Cancellation

You may cancel your subscription at any time through your account dashboard. Upon cancellation:

• You retain access until the end of your current billing period
• No partial refunds are provided for unused time
• Your data will be retained for 30 days, then permanently deleted
• You may export your data before deletion upon request

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Community Swarm and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you provide through the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Community Swarm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, resulting from:

• Your use or inability to use the Service
• Any unauthorized access to your data
• Actions taken by Discord or Telegram against your accounts
• Any third-party conduct on the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Indemnification

You agree to indemnify and hold harmless Community Swarm, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
